ELECTION COMMISSION

ARTICLE 324  PART -XV

The commission presently consists of a  CHIEF Election Commissioners and two Election Commissioners, appointed by the president.

Until October 1989, there was just one Chief Election Commissioner. In 1989, two Election Commissioners were appointed, but were removed again in January 1990. In 1991, however, the PARALIMENT OF INDIA passed a law providing for the appointment of two Election Commissioners. This law was amended and renamed in 1993 as the Chief Election Commissioner and other Election Commissioners (Conditions of Service) Amendment Act 1993. As of Sunday, 29 August 2010, the CEC is S.Y.QURAISHI  Establishment of commission is on 25 Jan 1950 before one day of Republic Day.

The Chief Election Commissioner may be removed from his office in like manner and on the like grounds as a judge of the Supreme Court It means the Chief Election Commissioner may be removed from office by Parliament by passing a resolution to that effect, passed by special majority on the ground of proved misbehaviour or incapacity.

 The Election Commission shall consist of a Chief Election Commissioner and such other Commissioners as the President may, from time to time, fix. Other Election Commissioner may be removed by the President on the recommendation of the Chief Election Commissioner. Salary of chief election commissioner is same as justice of supreme court of India.

All three commissioner have same right of taking a decision.

Tenure of commissioners is 6 years or up to age of 65, whichever is earlier.

 The Election Commission of India has completed more than 300 elections.

The Election Commission shall have the power of superintendence, direction and control of all elections to parliament and the state legislatures and of elections to the office of the President and Vice-President.

 Union Public Service Commission

Part XIV - Services Under the Union and the states - Article no. 315 to 323

The very first Public Service Commission was set up on 1 October 1926 by the then British Indian Government in response to the demands of Indian politicians that the superior Civil Services be Indianized. The functions of this Public Service Commission were largely advisory and, because of this limitation, it failed to satisfy the demands of Indian political parties associated with the struggle for freedom. The British Indian government then set up a Federal Public Service Commission and provided for the formation of provincial level Public Service Commissions under the Government of India Act 1935.

The chairman and other members of the UPSC (Union Public Service Commission) are appointed by the President of India. At least half of the members of the Commission are Civil Servants (working or retired) with minimum ten years of experience either in Central or State service.

Every member holds office for a term of six years or until he attains the age of sixty-five years, whichever is earlier.

He can submit his resignation at any time to the President of India. He may be removed from his office by the President of India on the ground of misbehavior (only if an inquiry of such misbehavior is made and upheld by Supreme Court) or if he is adjudged insolvent, or engages during his term of office in any paid employment outside the duties of his office, or in the opinion of the President unfit to continue in office by reason of infirmity of mind or body.

Article 315to 323  Part- XIV

State public service commission ap consist of chairman & member appointed by Governor of the state.

Term of six year or until they attain the age of 62 years.

Present chairman is Venkat ramreddy (till date Feb 15 2011)

    Finance Commission 

Article 280

Finance Commission for the purpose of allocation of certain resources of revenue between the Union and the state Government.

It consist of a chairman & 4 members to be appointed by President of India.

The qualifications, powers and procedures of the Commission itself are regulated by the Finance Commission (Miscellaneous Provisions) Act1951. Such Commissions are deemed to be civil courts for the purposes of the Code of Criminal Procedure 1898.

National Commission for Scheduled Castes  &  National Commission for Scheduled Tribes.

Under Articles 338 and 338A, provides for two statutory commissions - theNational Commission for Scheduled Castes, and National Commission for Scheduled Tribes.

According to the 61st Round Survey of the NSSO ,almost nine-tenths of Buddhists and one-third of Sikhs  in India belonged to scheduled castes of the Constitution while one-third of chirstains belonged to scheduled tribes. The sachar Committee report of 2006 also confirmed that members of scheduled castes and tribes of India are not exclusively adherents of Hinduism

The Constitution (Scheduled Castes) Order 1950 lists 1,108 castes across 25 states in its First Schedule. The Constitution (Scheduled Tribes) Order 1950 lists 744 tribes across 22 states in its First Schedule

Separate National Commission for SCs&STs  came into existence in 2004.It consist of chairman, vice – chairman& other 3 members appointed by President of India.
